72 Hour Health Guaranty

The puppy/dog has been examined by a licensed veterinarian, has been given a clean bill of health and deemed free of vermin at date of transfer.  Buyer, by signing this contract and agreement of sale, agrees to have said puppy/dog re-checked by a licensed veterinarian of their choosing within  seventy-two (72) hours of the date of transfer.  This veterinary examination is mandatory to confirm that your puppy/dog was not sick or injured at the time of delivery.  The Seller shall not be responsible for any veterinarian bills the Buyer may incur regarding said puppy/dog.

 

The sale of certain dogs and cats described as being registered or capable of being registered with any animal pedigree organization is subject to the provisions of the the Maryland Code, Commercial Law, Title 13, Consumer Protection Act.  In the event that a licensed veterinarian certifies your animal to be unfit for purchase within seventy-two (72) hours following receipt of said puppy/dog, you may choose: (i) to return said puppy/dog and receive a refund of the purchase price, less the non-refundable deposit; or (ii) to return said puppy/dog and receive an exchange animal of your choice of equivalent value.

 

In order to exercise these rights the Buyer must present a written veterinary certification that said puppy/dog is “Unfit For Purchase” to the Seller post marked within three (3) business days after receiving such certification.

 

One Year Congenital Health Guaranty

 

The Seller guarantees the puppy until one (1) year of age against life threatening congenital defects.  The Buyer understands that any medical condition that is preventable, treatable or manageable by routine veterinary care is not deemed life threatening under the provisions of this guaranty.  The Buyer further understands that due to the many factors and causes of the following conditions, i.e. trauma, environmental upset or not deemed life threatening are not covered by this guaranty:  Over bite or under bite, hernia of any kind, retained testis or suitability for breeding, tracheal collapse, open fontanel, grade 1 heart murmur or luxating patella.  This guarantee also does not apply to minor physical flaws including but not limited to erect ears, adult size, color, hair texture or conformation.

 

If the puppy/dog is found to have a life threatening congenital defect on or before the puppy/dog’s one (1) year birth date, Seller must be notified of the problem within twenty-four (24) hours of Buyer obtaining reports (at Buyer’s expense) from two (2) different licensed Veterinarian’s indicating the same problem.  The Buyer must also forward a copy of the letters of diagnosis from each Veterinarian to the Seller’s attending Veterinarian for review and verification.

 

In the event of death, an autopsy must be performed, (at Buyer’s expense), by a licensed Veterinarian to determine the exact cause of death before either option will be honored by Seller.  The report from the autopsy must be sent to Seller’s attending Veterinarian for review and verification.  The Seller is not responsible for any Veterinarian bills the Buyer may incur regarding the puppy/dog.

 

The Buyer will then be entitled to either of the following:

 

A.     Return the puppy/dog (at Buyer's expense) for replacement of a puppy of equivalent quality from the next litter bred by the Sellers.  The puppy/dog must be returned with the registration papers (if applicable).  Or,

 

B.     Keep the puppy/dog and receive a full refund of the original purchase price less the non-refundable deposit and applicable shipping costs within ninety (90) days of receipt of required documentation as stated above.

 

Buyer understand that if puppy/dog has been sold with limited AKC registration and alteration (spay/neuter) has not occurred by six (6) months of age and a licensed Veterinarian has not warranted the procedure as life threatening in writing, the One Year Congential Health Guaranty is rendered null and void in its entirety.  No replacement or refund will be provided.

 

 

In order to maintain the guarantees outlined herein, Buyer agrees to give the puppy/dog proper physical and emotional care and welfare. In so doing, Buyer agrees to maintain the puppy/dog in good physical health, provide proper and secure indoor housing, maintain routine preventative health care including, but not limited to feeding of a high quality diet, provide proper grooming, inoculations, internal and external parasite removal and when indicated heartworm preventative.  At no time may Buyer euthanize the puppy/dog without Seller’s acknowledgement and approval or urgency of a Licensed Veterinarian.  Under no circumstances will the Buyer sell, abandon, or give away the puppy/dog.  If for any reason other than those specified by the health guarantees contained herein the puppy/dog cannot be kept by the original Buyer, the puppy/dog must be returned to Seller (at Buyer’s expense), unless other arrangements are agreed upon by Seller. Registration Papers (if applicable) and Health Records must be signed over to Seller upon the return of the puppy/dog and no refund will be provided.

 

 

THE HEALTH GUARANTEES CONTAINED HEREIN ARE NULL AND VOID IF THE PUPPY IS NOT TAKEN TO A LICENCED VETERINARIAN WITHIN 72 HOURS FROM THE DATE OF TRANSFER!!!  The Guarantees contained herein are valid only for the original Buyer and is non-transferable.  The Guarantees contained herein are null and void if any of the above is caused by abuse, neglect, accident, environment or improper diet (overweight or lack of nutrition).
